Letter: Parking 'tickets' can be cancelled easily

With reference to letters about parking "tickets" being issued at Meole Brace Retail Park, customers and staff should realise that these are in no way the same as parking fines issued for parking incorrectly on a road, which are legally enforceable.

These "speculative invoices" are seldom enforceable and in any case only after all proper procedures have been followed. This is not usually the case and they can be easily cancelled.

I have recently represented someone who was told in three letters that the parking company had acted correctly and the person had to pay or face the possibility of county court proceedings, with costs escalating to £160. The result? An appeal was submitted to the independent appeals service POPA and when the matter was considered, the parking company did not even bother to contest the matter and the case was dismissed.

I have been involved with three cases in the past few months and they have all ended up cancelled.

There was an excellent article about this recently in the Shropshire Star, but it indicated that people should appeal against a ticket put on their car. In fact, people receiving a ticket on private property should do nothing at first, and wait for a "notice to Keeper" to be sent in the post. This can strengthen their position during an appeal.
