Amarjit Singh, 25, of Park Terrace, Prees, had parked his moped on Castle Hill, Whitchurch, while he saw in the New Year with friends.

Shrewsbury magistrates heard that in the early hours of New Year's Day he decided to move his moped. But he was stopped by police.

Abbie Hall, prosecuting, said: "Police officers on mobile patrol stopped a moped which the defendant was driving. They smelt alcohol and he was breath tested at the road side and blew positive."

Adrian Roberts, for Singh, said that he had decided to move his moped out of the way of some local youths.

Singh admitted driving a motor vehicle when the amount of alcohol in his body was above the legal limit. A roadside breath test recorded a level of 40 microgrammes of alcohol in 100 millilitres of breath.

He was fined £120 and ordered to pay costs of £135 and a victim surcharge of £20.
