Man spared jail despite second assault

A man has been spared jail for a second time after assaulting his ex-girlfriend.

Judge Anthony Lowe warned Gary Biggs, of no fixed address, that he would be going to prison in the future if he did not get his anger problems under control.

The 35-year-old appeared at Shrewsbury Crown Court on Tuesday for breaching a suspended sentence order and assaulting his then girlfriend at her Telford home on May 12 last year.

Biggs was found guilty of common assault at Walsall Magistrates on August 29, 2017. Antony Longworth, prosecuting, said Biggs pushed the victim over during an argument about her seeing the father of her three children.

He said: “The father of the children was visiting them at her address and Mr Biggs felt put out by that.

“An argument developed about the children being an inconvenience.” Biggs left the house but returned an hour later and assaulted her.

Mr Longworth said the victim fell on to a pot a paint and was screaming and crying in pain. Biggs had already been given a 14-month sentence, suspended for 18 months, on March 7, 2017, for a previous assault in June 2016.

Judge Lowe extended the suspended sentence until March 6, 2019 and ordered Biggs to complete a community order.

He added: “I don’t want you to get the message that this doesn’t matter. You have a very, very real problem with relationships.

“You don’t like the father of her children coming round to her house but these are all your problems of insecurity and jealousy that manifest in anger.”

Judge Lowe said that such actions needed to be stamped out before they led to more serious abuse.

He said: “A push is domestic violence and pushing leads to punching.”
