Care worker Alison Hind, 28, was killed in the crash on the A44 between Llanidloes and Aberystwyth on June 17, 2014.

Her uncle Martin Pugh, 47, who was driving the car, and his parents-in-law John Kehoe 72, and Margaret Kehoe, 65, also died in the crash, which happened when the family were on the way back from the seaside.

However Ms Hind’s daughter Holly, who was 18 months old, was pulled alive from the wreckage and survived.

The family have now issued a writ to the High Court in London to seek the damages, for Holly, now five, and her brother Ethan, three.

The writ says that the crash happened during a momentary lapse of concentration on the part of Mr Pugh, which resulted in him colliding head on with a fuel tanker.

It has been issued against Royal and Sun Alliance Insurance PLC, by the administrators of Ms Hind’s estate, Holly’s father Stephen Hughes, of Llanidloes and Paul Gough, of Shortbridge Street, Llanidloes.

The writ says the insurers have admitted liability for the accident.

However, the two sides are unable to agree a settlement, and are asking the court to decide.

Compensation is being sought for Mr Hughes and the two children.

The writ accuses Mr Pugh of negligence, and says he lost control of his car, drove head onto into a tanker, drove recklessly or carelessly, drove too fast, failed to keep a proper look out, and failed to brake or swerve to avoid the collision.

At the time of the crash, a family statement said: “Their passing is a great loss to us all and our pain has been increased so much by having them taken from us at the same time and in such tragic circumstances.

“Although we mourn their deaths we take comfort from the warmth and love of the family they left behind.”

Describing Mr Pugh, the statement said: “He was a devoted family man and a dedicated partner to Lynn and dad to his two children Matthew and Nicole. For the last 11 years he has cared for his partner Lynn but previously worked at Laura Ashley’s.”
