Telford man banned from the road despite 'no evidence' he was driving

A Telford man has been disqualified from the road for 12 months for failing to give a specimen of breath when asked by police, despite the court conceding there was no evidence he was driving a car.

Telford Magistrates Court heard on Tuesday that Shahid Hussain, 24, of Hadley, was in a car spotted by West Mercia Police being driven without a rear light earlier this year on August 21.

Deputy District Judge James Hulse heard that when police officers located the car, they found three men inside the vehicle, including Hussain, but none were in the driving seat.

The judge told Hussain that while he accepted that the prosecution cannot prove that he was the driver of the car, he said police only needed "reasonable suspicion" to insist he give a sample of breath.
