Constable Peter Franklin, 44, who lives in a village on the edge of Shrewsbury, had denied stealing a mobile phone worth £25 from West Mercia Constabulary between April 20 and 28 last year. He declined to comment on the matter as he left court yesterday. District Judge Neil Thomas, sittig at  Gloucester Magistrates Court, found that the CPS had committed an "abuse of process" by indicating it would drop the case but then changing its mind and proceeding. The incident happened in The Square at about 12.20pm on Saturday. The man told the teenager he was a police constable and asked to see his wallet. Later the youngster realised that £170 had been taken. Police are appealing for witnesses and urging people to be on their guard in case he strikes again. Constable Colin Barrett said the 15-year-old was with a 14-year-old boy and 13-year-old girl. They went to sit down on steps at the Old Market Hall, but a man was already there. Pc Gopal Dehar is accused of dragging the woman in her 20s into the bedroom of her Bloxwich home and having sex with her after returning from an evening out in June 2003. Dehar, aged 34, formerly of Franchise Street, Darlaston, denies the charge and is standing trial at Warwick Crown Court, in Birmingham. Outlining the case yesterday, Graeme Simpson, for the prosecution, said Dehar had received the woman's phone number from another police officer who met her after a break-in. Pc Geoff King was discharged from hospital last night just under a week after suffering bullet wounds to his shoulder and arm. The officer, who has a young daughter, was flooded with best wishes from the public and colleagues as he recovered in hospital following the shooting last Saturday. Marcus Bailey, aged 25, is alleged to have fired at the Graiseley neighbourhood officer, hitting him twice, during a routine car crime crackdown. Bailey, of Warnford Walk, Merry Hill, was dressed in tracksuit bottoms and a tracksuit top when he appeared before the city's magistrates' court on charges of attempted murder, possession of a silver Magnum revolver with intent to endanger life and resist arrest and possession of a lock knife.
